But new guidance from the Courts and Tribunals Judiciary warns coroners not to confuse online presence with genuine courtroom expertise when selecting expert witnesses.

The guidance, published in Chapter 14 of the Coroners’ Bench Book, arrives as expert witness work becomes more commercial, more competitive online and increasingly tied to personal branding, coaching services and social video content.

A search for “expert witness” now brings up a mix of official judiciary material, commercial directories, consultancy firms, law firms, podcasts and influencer-style legal commentary all competing for attention.

Courts Say Online Presence Can Be Misleading

The judiciary guidance warns coroners about relying on internet-based expert directories without checking how those experts are actually vetted.

It says coroners should look closely at whether registers properly assess training and competence before allowing someone to market themselves as an expert.

The concern inside the legal system is simple: digital presence can look like authority long before anyone tests it in court.

This is no longer confined to niche creators. Search results now include forensic specialists, medical professionals, litigation consultants and coaches all presenting themselves through short-form content and promotional material.

Many are properly qualified. Others are simply better at being visible.

YouTube Shorts Are Reshaping Expert Witness Marketing

Short legal videos are now everywhere across YouTube, TikTok, Instagram and LinkedIn.

Search results routinely surface clips on how expert witnesses work, courtroom cross-examination, deposition tactics, medical testimony, forensic analysis and even pricing and career advice.

Most are under a minute long and built for reach rather than detail.

The judiciary text does not criticise social platforms directly. It instead repeats one core point: expert witnesses exist to assist the court, not to support marketing, advocacy or reputation-building.

These short explainers now shape how many people first encounter the idea of expert evidence, often before they ever see how courts actually test it.

What Courts Expect From Expert Witnesses

An expert witness is defined as someone qualified to give opinion evidence on issues requiring specialist knowledge.

But the guidance focuses less on definition and more on behaviour inside the courtroom.

Experts must stay within their field, separate fact from opinion and make clear when conclusions depend on assumptions. They are also expected to highlight material that could weaken their own view rather than present a one-sided conclusion.

The principle running through the document is independence. Expert evidence is only useful to a court if it is not shaped by the side paying for it.

That becomes critical in inquests involving medical treatment, custody deaths, engineering failures or disputed causes of death, where expert evidence often sits at the centre of the case.

Why Scrutiny Is Tightening

The rise of online expert branding is happening alongside wider concerns about unreliable reports, unregulated practitioners and the use of artificial intelligence in professional evidence.

Recent legal commentary already shows warnings about AI-generated expert reports and debates around whether certain professionals should be giving evidence at all in complex cases.

The guidance notes that, in some situations, the absence of proper expert evidence can undermine the entire investigation, particularly where human rights obligations require a full and effective inquiry.

If the wrong expert is used, the consequences can be procedural delay, contested findings, legal challenge and increased public cost.

Why This Matters Beyond the Courtroom

The expert witness sector is becoming more commercial and more visible online.

That makes it harder for lawyers, insurers, healthcare providers and families to separate genuine specialist knowledge from polished online positioning.

A strong digital profile can attract attention, but it does not answer the central question courts care about: can this person’s expertise withstand scrutiny under oath?

As expert witness content continues spreading across short-form video platforms and legal social feeds, the judiciary’s message is increasingly direct — visibility is not evidence, and popularity is not qualification.
