The jury in Lindsay Clancy's murder trial were sent home on Tuesday after failing to reach a verdict. 

Earlier in the day, jurors told Judge William R Sullivan that they were unable to come to a unanimous decision on the fourth day of deliberations.

The jury, made up of nine women and three men, has spent a total of 23 hours deliberating Clancy's fate. Judge Sullivan sent them back out to continue weighing up their decision on Tuesday morning after they confirmed they could not come to an agreed verdict. 

The jury must decide whether Clancy is guilty of three murder counts after the former labor and delivery nurse killed her children Cora, 5, Dawson, 3, and Callan, eight months, using exercise bands at her home in Duxbury, Massachusetts, in January 2023. 

Clancy has pleaded not guilty in her case, citing postpartum depression, psychosis and overmedication by prescribers. Prosecutors acknowledged that Clancy was mentally ill, but maintain that she knew what she was doing at the time of the killings.  

Judge William Sullivan announced that the jury had asked to be excused for the day, and he agreed.

'My understanding is that you request to be excused until tomorrow at 9 o'clock, so I'm going to excuse you until then,' he said as several members appeared to nod.

'You've come this far, do not read anything, don't listen to anything, don't talk about this case.'

The panel of 12, made up of nine women and three men, have now deliberated for around 23 hours.

Earlier in the day on Tuesday, the jury told the judge they could not reach a unanimous verdict, but he ordered them to keep deliberating.

The jury had deliberated for 18 hours when they told the judge they could not reach a unanimous verdict.

They must reach a unanimous decision on whether Clancy is guilty of murder, manslaughter or not criminally responsible for her actions.

If the jury is unable to reach a verdict, the judge will eventually be forced to declare a mistrial.

The group has not be sequestered during discussions.

Breaking:Jury says they are unable to reach a unanimous decision

The Lindsay Clancy jury told the judge they are unable to reach a verdict after 18 hours of deliberations.

'Members of the jury I've got your question and the question is, "After many hours of deliberation we are unable to come to a unanimous decision,"' Judge William Sullivan said.

He acknowledged the length of the trial, but ordered the jury to continue deliberations and sent them back.

'I brought you back out because I know that this was a long trial, alright. I know that there were over 80 witness, there were over 300 exhibits, but because of that I'm going to ask you to back out, keeping in mind all of the instructions that I gave you, to go out and to continue you deliberations,' Sullivan said.

The panel of 12, made up of nine women and three men, must reach a unanimous decision on whether Clancy is guilty of murder, manslaughter or not criminally responsible for her actions.

If the jury is unable to reach a verdict, the judge will eventually be forced to declare a mistrial.

The Lindsay Clancy jury was dismissed for the day after they failed to reach a verdict on day four of deliberations.

The panel of 12, nine women and three men, has now deliberated for about 23 hours to determine whether Clancy is guilty of murder, manslaughter or not criminally responsible for her actions.

Lindsay Clancy's former colleague visited her in court today

A labor and delivery nurse at Massachusetts General Hospital who had worked with Lindsay Clancy for seven years visited her in court on Tuesday.

Margaret Hamp was escorted inside Plymouth County Superior Court by an investigator hired by Kevin Reddington during the trial. Hamp was inside for a few minutes before she was escorted out again.

Hamp was the first defense witness who described Clancy as 'compassionate' and 'really good at being a nurse.' On the stand, she said the two discussed Andrea Yate's harrowing case long before Clancy's incident, which the Massachusetts mom asked: 'How could a mother hurt her children?'

Yates drowned her five children in a bathtub in Houston in 2001, but was found not guilty by reason of insanity in the case.

Reddington reacts to jury being sent home

Kevin Reddington told reporters that he is encouraged by the jurors' request to be dismissed for the day.

'The fact that they have not said that they're done is very, very heartening; obviously, they're working very hard,' he said.

'It's obviously very encouraging. I think that they're showing that they're more than willing to keep working at it.'

Reddington also criticized District Attorney Tim Cruz for pursuing the first-degree murder charges against Clancy,

'You should ask Mr. Cruz why he did not reduce the charges to second degree so that the matter could be waived by a jury and tried by a judge,' he said.

'You should ask Mr. Cruz why we're trying a case on triple homicide, first degree, not me.

Reddington continued: 'The judge has no control over it; I have no control over it; it's entirely up to the DA.'

Parties called back to courtroom

Those involved with the Lindsay Clancy trial have been called back into the courtroom.

Clancy sat at the defense table, while Kevin Reddington leaned on the judge's bench before going to speak with one of his experts.

District Attorney Tim Cruz is sitting behind the prosecution.

Patrick and Lindsay Clancy are suing her medical providers

Both Patrick and Lindsay Clancy have filed separate lawsuits against several of her medical providers alleging that they overmedicated the mom while treating her for postpartum mental health issues.

This overmedication led to her conditions worsening, and ultimately to the deaths of the children, the suits claim.

Many of the providers they are suing took the stand during her murder trial, including Dr Jennifer Tufts and Nurse Rebecca Jollotta.

The civil suits are still making their way through the courts.

Lindsay Clancy trial witness RESIGNS from hospital job hours after testifying against her

A psychiatrist who testified against Lindsay Clancy at her murder trial resigned from his hospital job hours after taking the stand.

Dr Avram Mack concluded that the 36-year-old was criminally responsible for killing her children after he interviewed her in April this year.

He then repeatedly clashed with defense attorney Kevin Reddington under cross-examination.

Last week, after he finished his testimony, Mack, 54, resigned from his role as a psychiatrist at Nemours Children's Health in Delaware.

Lindsay Clancy visited in court by nurse friend she discussed Andrea Yates

Margaret Hamp, the labor and delivery nurse at Massachusetts General Hospital who had worked with Clancy for about seven years, stopped by the courthouse today.

She was just taken inside the courtroom - likely to see Clancy - by Reddington's private investigator Bob Jones.

She was in for only a few minutes before he escorted her back out again.

Hamp was the first defense witness who described her as 'compassionate' and 'really good at being a nurse.'

'She was really compassionate. She was kind. She was the kind of nurse you wanted taking care of you,' Hamp testified.

She also testified about a conversation they once had about Andrea Yates.

There was a patient who came to the hospital and had plans to harm herself when she was pregnant.

Clancy had just started that summer at the hospital and they spoke about postpartum mental illnesses, she said.

The nurse said she asked her if she knew about the Andrea Yates case.

Clancy said she didn't. When Hamp told her, she said that Clancy had cried and asked: 'How could a mother hurt her children?'

Clancy's case has been compared to Yates.

Yates drowned her five children in a bathtub in Texas in 2001. Her attorneys said she suffered from postpartum psychosis and believed killing her children would save them from hell.

Her initial murder conviction was overturned, and in a retrial she was found not guilty by reason of insanity and committed to a state mental hospital.
