Popular retro gaming handhelds preloaded with thousands of unlicensed games could soon face federal intervention as major industry groups push for stricter trade penalties.

The Entertainment Software Association, representing the likes of Nintendo, Sony, and Microsoft, filed an official comment with the Office of the United States Trade Representative requesting aggressive enforcement against manufacturers producing devices packed with copyrighted ROMs. Basically, the group is urging U.S. trade officials to include manufacturers of illicit plug-and-play consoles and portable handhelds on the government’s annual Notorious Markets List that targets international operations that facilitate large-scale intellectual property infringement and commercial counterfeiting.

Within this petition, the label of "superfakes" was used for popular handheld devices made by manufacturers such as Anbernic. These portable systems frequently replicate the tactile feel, screen quality, and design of legitimate mass-market gaming hardware, featuring polished casings, molded buttons, vibrant displays, and custom UIs. However, the trade group notes that the primary commercial appeal of these devices rests heavily on included microSD cards or internal storage drives pre-installed with thousands of unauthorized game copies spanning multiple console generations, including the NES, Super Nintendo, Sega Genesis, Sony PlayStation, and Game Boy platforms.

Thus by packaging these machines with complete library archives out of the box, manufacturers eliminate the barriers that typically kept mainstream consumers from seeking out pirated files online. The submission argues that a single pre-loaded handheld directly displaces legitimate commercial sales across multiple publishers, undermining active digital storefronts, licensed classic compilations, retro subscription services, remasters, and official retro hardware re-releases. Furthermore, the retail prices of these handheld devices frequently reflect the perceived value of the bundled game libraries rather than the raw cost of the physical hardware components alone.

In response, the group outlined seven enforcement measures for authorities and law enforcement agencies to implement, including treating preloaded unauthorized game libraries as direct evidence of commercial-scale piracy, inspecting bundled storage media during customs processing, requiring online sellers to prove authorization for included software, and shutting down linked storefronts rather than merely removing individual product listings. Additionally, there's a call for preserving detailed merchant and transaction records for legal enforcement, enhancing border customs targeting for hardware components associated with pre-loading operations, and establishing coordinated international action against manufacturers, exporters, fulfillment centers, and major e-commerce platforms that knowingly facilitate sales.

Now, if officials do adopt these recommendations, federal authorities could choke off import channels, restrict fulfillment services, and pressure online marketplaces to ban repeat sellers. For retro gamers accustomed to buying ready-to-play handhelds, the proposal could make acquiring these plug-and-play devices significantly harder in the U.S. market.
