An alarming crash in Georgia is putting aftermarket suspension-lift kits under the microscope after a man was killed in a collision involving a pickup truck with such a modification.
One Charles Holloway died when a lifted Ford F-150 crashed into his Toyota Tundra, allegedly crossing the centre line on a highway and plowing headlong into him, according to industry outlet Repairer Driven News. At issue is the fact the F-150 was equipped with an aftermarket lift kit, one apparently raising the truck some six inches over stock. This alteration, the lawsuit alleges, is the reason Holloway perished in what otherwise might have been a survivable crash.
Lawyers on the case have hurled allegations at numerous parties, including the driver of the truck, Scott Douglas Kneiss; the dealership that sold the rig; the business that installed the suspension lift-kit; and the manufacturer of said aftermarket equipment. “The lifted Ford F-150 overrode and bypassed the Toyota Tundra’s engineered crash protection systems and entered the occupant compartment and driver survival space of the Toyota Tundra,” allege state court documents. An outfit called The Cooper Firm filed the lawsuit on behalf of Holloway’s wife, Lolita Holloway.
The suit points to prior crashes and litigation as warning signs the defendants should have seen before installing the kit. It then goes on to talk about basic physics, the dangers of significantly altering a vehicle’s suspension geometry, and warnings from the original manufacturer about installing such modifications. Lawyers for the plaintiffs also argue the lift kit was defective and unreasonably dangerous; and it is worth noting that Georgia apparently prohibits changes to a vehicle’s ride height of more than two inches from factory, whether up or down.
This incident has been under some scrutiny, appearing in industry publications and also being the focus of a presentation at a conference attended by professionals from the collision-repair industry.
