James Talarico says Texas voter ID rules discriminate against students, but the identification cards he wants accepted at polls are also available to illegal aliens who meet the state’s graduation and residency requirements.
Democrat Senate candidate James Talarico’s CNN town hall offered voters another look at his position on voter ID and the role student identification cards should play in Texas elections. His argument also raised questions about identification available to illegal aliens enrolled at public colleges and universities.
Talarico tried to present himself as a supporter of voter ID while criticizing existing Texas policies as discriminatory. He focused on the state’s acceptance of concealed carry licenses and its rejection of student identification cards at the polls.
The candidate framed his position as support for what he called fair voter ID. Rather than rejecting identification requirements outright, he argued that Texas should accept additional forms of identification and apply its rules consistently.
“I am for fair voter ID,” Talarico told the forum. “And I say fair because here in Texas, I think that a lot of our voter ID policies are discriminatory… some forms of ID are allowed, and other valid forms of ID aren’t allowed.”

Talarico then highlighted the difference between concealed carry licenses and student identification cards. His complaint centered on the fact that one can be presented when voting in Texas while the other cannot.
“For instance, when you got to vote here in Texas you can bring your concealed carry license, which I am all for, but a student at a public college or university, can’t bring their student ID.”
He argued that this distinction benefits certain voters while harming others. “So I think that hurts some kinds of voters, and helps other kinds of voters. What I want to see is voter ID that is consistent across the board.”

The issue does not stop with a simple comparison between gun owners and college students. Illegal aliens can acquire student identification cards in Texas under state rules governing enrollment and identification at colleges and universities.

According to the state law, students can receive identification from a college or university regardless of their citizenship status if they meet certain conditions. Those conditions include graduating from a Texas high school and living in Texas for three years before graduation when they enroll.
That means the student identification cards Talarico wants accepted are not limited to American citizens. They are also available to illegal alien students who satisfy the state’s high school graduation and residency requirements.
The process is not obscure or hidden from students who may qualify. Public universities in Texas provide instructional material to illegal alien enrollees explaining how they can receive student identification cards.
Those universities also provide information about acceptable documents that can be used during the process. The available materials include guidance regarding documents issued by foreign governments that may be presented to obtain student identification.
Talarico’s proposal would therefore expand acceptable voter identification to include a credential that illegal aliens can obtain through Texas colleges and universities. His CNN appearance placed that proposal alongside his accusation that the current state rules are discriminatory.
The disagreement comes as Talarico seeks to move the Texas Senate seat into Democrat hands for the first time since 1993. He is running against Republican candidate Ken Paxton in the contest.
Early voting for races across Texas begins in three days. With voting approaching, Talarico’s comments give Texans a clear view of his preferred approach to identification requirements and the student ID loophole at the center of the dispute.
