Owners of the EV have been asked to limit charging the battery to 70% until it's repaired—a lawsuit says that's not acceptable
The plaintiffs are seeking $5,000 in punitive damages on behalf of all Canadians who own, have purchased, or have leased a 2025 Volvo EX30 affected by the battery defect Photo by VolvoOver the past few years, several electric vehicles (EVs) have been recalled due to a defect with their high-voltage batteries posing a fire risk. And it’s common for automakers to ask the owners of these EVs to limit their battery charging – and to avoid parking them in garages – to reduce the some of that risk until the car has been repaired. Some of those owners have, in turn, launched class-action lawsuits in Canada now that their vehicles’ recharging and range capabilities have been (temporarily) diminished—we’re talking Nissan Leaf, Chevrolet Bolt, Audi e-Tron, and Jeep 4xe.
Now a similar suit has been levelled against Volvo and its 2025 EX30 electric SUV. The plaintiffs are seeking compensation because, the lawsuit alleges, the manufacturer’s failure to fix the battery defect after more than nine months is “unreasonable.” It notes, too, that Volvo apparently refused to provide replacement vehicles while the repair was pending.
Among other remedies, the plaintiffs are seeking $5,000 in punitive damages on behalf of all individuals in Canada who own, have purchased or leased, or use a 2025 Volvo EX30 affected by the defect.
Montreal law firm ML Kaufman is leading the charge, with Leslie Stefani as their representative. A Beaconsfield resident, Stefani leased a Volvo EX30 from Volvo Laval in October 2024. Unfortunately, 2026 got off to a very bad start for her and other Volvo EX30 owners or lessees. On January 2, the manufacturer issued its first international safety recall, followed by a second in February. In Canada, Transport Canada published two notices (#2026-001 and #2026-078) indicating a total of 1,631 vehicles were covered by the safety campaign.
The issue: the EX30’s high-voltage battery cells could overheat and cause a short-circuit. That means a fire risk, even while the vehicle is parked and turned off. For this reason, the manufacturer urged Volvo EX30 owners to keep the battery charge below 70%; and to park outdoors, away from other vehicles and structures. The recall affects nearly 40,000 vehicles worldwide, reports CarScoops.
According to documentation Volvo submitted to the U.S. National Highway Traffic Safety Administration (NHTSA), the recalled EX30s are equipped with batteries supplied by Chinese manufacturer Shandong Geely Sunwoda Power Battery, and installed in the EX30 through October 25, 2025. Volvo says models built after that date are not affected.
All 2025-model-year trims of the compact EV are affected, including the two-wheel-drive (Single-Motor Extended Range) and the four-wheel-drive (Twin-Motor Performance) versions. The range of these two configurations varies from 327 to 420 kilometres. Charging them to only 70% of their capacity reduces the total driving range by roughly 125 km.

No repair date was mentioned at that time. Several emails followed from the manufacturer, first informing her that corrective measures were being developed; then that replacement parts, specifically new battery modules, were not available.
The most recent email, from September 30, informed Stefani replacement parts were becoming available, but in limited quantities. As of October 2, Stefani had still not received specific information about when her Volvo EX30 would be repaired.
Regarding the EX30 battery recall, the fix consists of replacing the battery modules containing the affected cells free of charge. All affected customers have been contacted regarding the issue and retailers will contact customers as soon as the parts are available for their cars. Until then, customers should continue to limit their charge level to 70% until their car is inspected and fixed.

In addition to punitive damages of $5,000, the lawsuit seeks compensatory damages in an amount to be determined “once the safety defect has been repaired”; or cancellation of the purchase or lease agreement.
If you leased or purchased a 2025 Volvo EX30, the attorneys at ML Kaufman law firm, Jack Kermezian and Albert Greenspoon, invite you to contact them.
Until the situation is resolved, Volvo recommends taking the following steps to set the maximum charge level to 70%.
According to Volvo, if overheating were to occur, “it would trigger a warning message on the dashboard.”
