A few days after a 2025 ticket was dropped against Brian Jenkins, he was ticketed again on October 3 for carrying a sign calling for prayers to end abortion.

(LifeSiteNews) — A man witnessing for life, holding a sign calling for people to “pray” to end abortion was ticketed again by police in the province of Quebec for his pro-life witness after his first ticket was dropped, leaving his lawyer baffled but determined to help clear his client’s name.
Brian Jenkins of Sherbrooke, Quebec, was given a ticket in 2025 for displaying signs calling out abortion during the annual “40 Days for Life” campaign that takes place nationwide.
After legal pressure, the Justice Centre for Constitutional Freedoms (JCCF) said in a press release sent to LifeSiteNews that Jenkins’ first ticket was dropped on September 30, 2026. However, his constitutional lawyer, Mr. Olivier Séguin, was not notified.
Jenkins was again ticketed on October 3 for the same pro-life witnessing shortly after the first ticket was taken away. The JCCF noted that both tickets are based on a city bylaw banning “sandwich boards,” but that applies to commercial advertising.
Earlier this year, LifeSiteNews reported on Jenkins’ case and the JCCF’s legal assistance.
Jenkins, as noted by the JCCF, was simply “expressing his personal views, not promoting a business.”
Séguin said that Jenkins’ peaceful expression arguments will be brought up at a trial, and the attorney called out the tickets as an act of “silencing” one’s ability to express freedoms.
“The City withdrew one ticket without notifying counsel while police issued another for the same peaceful activity,” Séguin said.
“Canadians should not have to guess whether expressing their convictions will bring another prosecution,” he continued. “Fair process requires clear communication, consistent enforcement, and respect for constitutional freedoms. A bylaw governing commercial advertising should not be used to silence peaceful expression.”
The JCCF said that while it welcomes the withdrawal of the first ticket, no court has “ruled on the application of the bylaw to his peaceful expression.”
“The new ticket leaves unresolved the concern that police are using a commercial advertising regulation to restrict participation in public debate,” the JCCF said.
It noted that Séguin is seeking a “prompt hearing on the second ticket, where he intends to challenge its use to restrict Mr. Jenkins’ constitutional freedoms.”
Quebec, as reported by LifeSiteNews, is one of the most pro-abortion provinces in Canada and has in place so-called “bubble zone” laws in front of abortion clinics.
Indeed, the National Assembly of Quebec last year introduced a bill that aims to establish a provincial constitution enshrining abortion and euthanasia “rights.”
So-called “bubble zone” laws are becoming more commonplace in Canada, notably during former Prime Minister Justin Trudeau’s near-10-year reign from 2015 to 2025.
In many Canadian provinces as well as cities, so called “bubble zone” laws are in place that target pro-life witnessing. Some cities have backed down on expanding such laws, however.
Many Canadians have been arrested or fined as a result of the laws taking legal action to clear their name.
